TrustSpark Terms of ServiceEffective Date: December 31, 2025These Terms of Servie ("Terms") govern your access to and use of the TrustSpark mobile application, website, and related services (collectively, the "Service") provided by TrustSpark LLC ("TrustSpark," "we," "us," or "our"). By downloading, accessing, or using the Service, you agree to be bound by these Terms, our Privacy Policy, and any additional guidelines or rules we may post. If you do not agree, do not use the Service.These Terms form a legally binding agreement between you and TrustSpark. We may update these Terms from time to time. Your continued use constitutes acceptance of changes. If changes are material, we will notify you via the app or email.1. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using TrustSpark, you represent and warrant that you meet this requirement, are not a registered sex offender, and have not been convicted of any felony or indictable offense involving violence, fraud, or sexual misconduct. We may verify your identity and background for safety purposes.2. Account Registration and Security
To use certain features, you must create an account with accurate and complete information, including your real name, age, and a valid email or phone number. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately of any unauthorized use.You may not share your account or use another's without permission. We reserve the right to suspend or terminate accounts for violations.3. User Conduct and Community Guidelines
TrustSpark is designed to foster genuine, respectful connections built on trust. You agree to:
- Use the Service only for personal, non-commercial purposes.
- Provide truthful information and not misrepresent yourself (e.g., age, identity, intentions, photos).
- Treat others respectfully—no harassment, bullying, hate speech, discrimination, threats, or abusive behavior.
- Not engage in illegal activities, scams, spam, solicitation, or prostitution.
- Not post explicit sexual content, nudity, violence, or harmful material.
- Respect privacy: Do not share others' personal information without consent or attempt to dox anyone.We encourage reporting of violations via in-app tools. Violations may result in content removal, warnings, account suspension, or permanent bans. We monitor activity through automated systems, user reports, and human review. Credible reports of off-app behavior that impacts safety may also lead to action.4. Content Ownership and Licenses
- Your Content: Photos, text, profiles, and messages you post grant us a worldwide, royalty-free, perpetual license to use, modify, display, and distribute as needed to operate, improve, and promote the Service. You represent that your content does not infringe third-party rights.
- Our Content: The Service's design, trademarks, logos, and features are owned by TrustSpark. You receive a limited, non-transferable license for personal use only.
- Other Users' Content: You may view other users' content through the Service but may not copy, distribute, or misuse it.We may remove any content for any reason, including violations of these Terms.5. Privacy and Data
Your privacy is important to us. Our separate Privacy Policy details how we collect, use, protect, and share data—including location for matching, identity verification, and safety features. By using the Service, you consent to these practices. We may share anonymized, aggregated data with partners.6. Payments and Subscriptions
Premium features (e.g., boosts, unlimited likes, advanced filters) require payment processed by third-party providers. Subscriptions auto-renew unless canceled at least 24 hours before renewal. No refunds for partial periods except where required by law (e.g., 14-day cooling-off period in the EU). Prices are inclusive of applicable taxes; we may adjust prices with reasonable notice.7. Safety and Interactions
TrustSpark prioritizes user safety with features like profile verification badges, reporting tools, photo verification, and optional background screening. However, we cannot guarantee the conduct or truthfulness of other users.You are solely responsible for your interactions. Use caution when meeting in person: choose public places, inform friends, and trust your instincts. We encourage immediate reporting of concerning behavior.We may perform limited background checks on some users but do not warrant their completeness or accuracy. You release TrustSpark from any liability arising from user interactions, whether on or off the Service.8. Disclaimers and Limitation of Liability
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee uninterrupted access, error-free operation, or that matches will be compatible or safe.To the fullest extent permitted by law, TrustSpark shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Service, including from matches, content, or interactions.In no event shall our total liability to you for any claim arising out of or relating to the Service exceed $100 if you have made any payment to us in the 12 months preceding the claim, or $0 if you have made no payments to us during that period.9. Indemnification
You agree to indemnify, defend, and hold harmless TrustSpark and its affiliates, officers, and employees from any claims, losses, or damages (including attorneys' fees) arising from your breach of these Terms, your content, or your use of the Service.10. Termination
You may delete your account at any time through app settings. We may suspend or terminate your access at any time, with or without notice or refund, for violations or other reasons. Upon termination, your license ends, but provisions regarding ownership, disclaimers, indemnity, and dispute resolution survive.11. Dispute Resolution and Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles.Any disputes arising from these Terms or the Service will be resolved through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. There is no class arbitration or class action. You may opt out of arbitration within 30 days of first accepting these Terms by emailing [email protected] with your name and account details.12. Miscellaneous
These Terms constitute the entire agreement between you and TrustSpark. If any provision is held invalid, the remainder remains enforceable. No waiver of any term is effective unless in writing.
